Does eSignR fulfil the legal requirements of the EÖBV (Swiss law for digital documents)?

To be able to create electronic documents in Switzerland in accordance with the EPDO, you must be a Swiss notary and registered in the UPReg. As long as you are registered there, you have the option of signing and notarising in ‘notary mode’ in the eSignR. All in accordance with the Ordinance on the Creation of Electronic Public Documents and Electronic Notarisations (EÖBV).

How is the confidentiality and integrity of the documents guaranteed?

The confidentiality and integrity of the documents are guaranteed by a careful process that begins with identification at an official registration centre at our partner Swisscom Trust Services.

 

During the signing process, the confidential document is loaded into the eSignR software and a hash value is generated that contains no document content and is sent exclusively to the certificate service provider. There, the user’s declaration of intent is queried using two-factor authentication. After confirmation, a digital signature with a time stamp is created and securely embedded in the PDF document. This means that the document remains on the computer throughout the entire process.

Is the electronic signature legally recognised for notaries in Switzerland?

Yes, qualified electronic signatures (QES) are legally recognised in Switzerland in accordance with ZertES and meet the requirements for a handwritten signature.

Which documents can notaries sign electronically?

Depending on the canton, the contact for the electronic signature may be handled differently. In most cases, it makes sense to contact the following offices:

 

  1. Commercial register offices: For documents such as commercial register applications and company formations. Depending on the canton, these offices are also responsible for electronic submission and signatures.
  2. Land registry offices: For registration confirmations and land register entries. In some cantons, electronic registration takes place directly via the relevant land registry office.
  3. Cantonal notary’s offices or chambers of notaries: These offices provide information and support for the electronic signature of notarial deeds and may also offer specific technical solutions.
  4. Certification services: Providers of qualified electronic signatures that are recognised in Switzerland and enable a legally valid signature. These providers often work together with the cantonal authorities.
